Introduction

 

The Terms & Conditions (“T&Cs”) apply to the use of the site www.gamestore.com.kw and it's retail store "GameStore" are owned by GameStore General Trading LLC.

The T&C's apply whether the user/customer are accessing this site through a computer, laptop, tablet, smartphone etc that either belongs to them or even partially under their possession.

The T&C’s identify the terms set out the relationship between GameStore and the consumer and the terms on which product/s are sold via the site and general terms applicable to the user/customer's use of the site and purchase of the same.

The user/customer may not use www.gamestore.com.kw if the user/customer does not agree to the T&C’s clearly laid out.

These T&C’s are effective from 14th April 2020 and will last until otherwise specified.

GameStore may change these T&C’s at any time by posting an updated version of the same on it’s site.

GameStore highly recommends users to read the T&C’s prior to purchasing from their site.

 

Privacy:

All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties

 

User Account:

The user/customer will need to register with GameStore to purchase product/s on the site.

The user/customer are responsible for maintaining the security and confidentiality of the user/customer account credentials.

The user is responsible for all activities associated with their account or profile. Please inform GameStore immediately (by email: cs@gamestore.com.kw) if the user/customer suspects any fraudulent or suspicious activities under the user/customer account.

All information provided by the user/customer (the customer) is correct, truthful and accurate. Should the user/customer for any reason change the user/customer residential address, contact details (phone, email etc) The user/customer can access and update the user/customer details. If the user/customer are unable to do so then it is the responsibility of the user/customer who must inform (in writing) GameStore of any such changes.

GameStore does not charge any fees (membership, service or otherwise) for creating an account or searching for product/s on the site.

Customers are solely responsible for payments including Taxes or any other government approved required fees. Should the product have to be sourced from overseas then the customer will be informed of the excise, customs, duties, shipping, delivery costs etc in advance before finalizing their purchase.

GameStore reserves the right to refuse access to the site, cancel accounts and orders at their discretion. If GameStore cancels an order there will be no charges to the customer account and if any charges were levied the user/customer may raise grievance with GameStore to settle within a reasonable timeframe (not exceeding 7 business days).

 

Purchases:

GameStore is not the manufacturer of the product/s and services sold on their site.

GameStore’s product description and details are provided by their suppliers (distribution partners etc) and this is communicated on the site. GameStore cannot ensure 100% accuracy. The user/customer should also perform due diligence and not rely solely on the information presented on the site. The user/customer may contact GameStore’s team privately to alert them of any errors the user/customer find.

GameStore makes every effort possible to display product details especially colors, dimensions etc as accurately as possible. Keep in mind that monitor resolution differs from device to device so GameStore cannot guarantee that the user/customer monitor's display will reflect accurately the colour of the product ordered and delivered. GameStore may edit product details on their site without prior notice.

Cancellations, Exchanges and Refunds:

Refunds will be done only through the Original Mode of Payment.

Deliveries:

GameStore utilizes its own dedicated delivery team to ensure timely and secure delivery of all products directly to customers. GameStore makes every effort to dispatch product/s on time. If the ordered product/s are not delivered within the time period GameStore specified in the confirmation email, please contact GameStore’s Customer Services immediately for further assistance.

Deliveries are carried out on all days (except Sunday) and are delivered to a physcial delivery address only (PO Boxes are not allowed). During which time responsibility for loss, breakage and damage passes to the user/customer. Ownership of product/s purchased passes to the user/customer when full payment is collected by GameStore. The user/customer is required to sign a document (delivery/AWB etc) on receiving their purchase as acceptance that the product/s are correct and in good condition.

GameStore is not responsible for delivery handling beyond the customer's door (example: living room, bedroom, bathroom etc). If the customer is not at their residence then the product may be left at the front door or with tenant's reception etc.

Orders and Delivery Outside The Kuwait:

GameStore does not deliver outside Kuwait.

www.gamestore.com.kw will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of Kuwait.

GameStore is not responsible for any charges levied by banks (international and domestic).

 

Use of the site:

GameStore tries to keep all information on this site up to date, but it may not be correct all of the time. The user/customer should independently check the information.

The user/customer must not conduct or promote any illegal activities while using this site.

Customers must not supply false information or make unauthorized payments via credit card.

Minors or those under 18 may browse the site but not purchase unless they are in the presence of their parent/guardian or anyone they are entrusted to by the parent/guardian or the authorized owner of the credit card or other mode of payment.

 

User Content and Behaviour:

The user/customer agree to comply with all legal requirements.

The user/customer must not post User Content that is offensive, disrespectful or abusive towards it's own or any other person or entity.

GameStore does not and cannot guarantee the accuracy, integrity or quality of User Content. Additionally, GameStore is not liable for any loss or damage incurred by the user/customer because User Content.

 

Losses:

GameStore will not be responsible for any losses the user/customer suffers as a direct result of GameStore breaching the T&C's even if those losses were reasonably foreseeable to both during the time purchase was made.

GameStore’s liability to the user/customer under these T&C's  will not exceed the total price charged for the product/s purchased.

GameStore will not be responsible for any losses the user/customer suffer as a direct result of GameStore breaching the T&C's even if those losses were reasonably foreseeable to both the user/customer and GameStore at the time the contract for the sale of product/s by GameStore to the user/customer was formed (which is formed at the time that GameStore sends the confirmation email or Message  to the user/customer).

 

Security:

GameStore does not endorse any third party supplier or User Content on this site.

It is the user/customer responsibility to have a secure and suitable browser. GameStore does not accept any responsibility for any functional or technical flaws/issues (example: slow internet connection, bad time out or any other issues) related to the user's browser.

 

Links to Third Party Sites:

The site may contain links to third party websites that are not owned or controlled by GameStore and GameStore are not responsible for the content or services provided by them. The user assumes any risk for accessing third party websites even if not prompted to do so by GameStore's site.

Please note that any other website accessed from our platforms is independent of GameStore and we have no control over the content or services provided by that website. GameStore absolutely does not endorse, support or accept any responsibility for the third party website content.

 

 

Suspending & Terminating user/customer account:

GameStore may cancel user accounts if it suspects that the user/customer is involved with fraudulent/illegal/criminal activities or any activities that harm GameStore or the general public through misinformation.

 

Force Majeure:

Neither party will be liable to the other under the T&C's or any other agreement between the parties, for any loss or damage which may be suffered by the other party due to any cause beyond the first party’s reasonable control including without limitation any act of God, exceptionally severe weather, failure of shortage of power supplies, flood, drought, lightning or fire, strike, lock-out, trade dispute or labor disturbance (other than those of the parties), the act or omission of government, highways authorities, other telecommunications operators or administrators or other competent authority, war, military operations, acts of terrorism or riot, royal demise etc.

 

Representations and Warranties:

The user/customer will comply with all applicable domestic and international laws and regulations related to ordering on the site.

 

Electronic Communication:

GameStore may choose to fulfill it's obligations to the user/customer under the T&C's and may communicate with the user/customer by email and by posting notices on the site.

The user/customer agree to receive communications from GameStore and that electronic communication will suffice as written communication.

GameStore may also send the user/customer promotional emails. The user/customer has every right to not receive such promotional emails and can request to be excluded by calling or emailing GameStore’s support team.

 

Intellectual Property Rights:

The site content is protected by copyright, trade mark and other intellectual property rights.

The user/customer may not use the site or any of its content for any commercial purpose, including any advertising or financial activity.

The user/customer may not purchase digital products, software or any products with registered intellectual properties to resell.

GameStore's logo is copyrighted and registered. No party may use their logo for any reason whatsoever.

GameStore is not responsible for any errors associated with advertising or sponsorship material on the site.

 

Relationship and Notice:

If any clause of the T&C's is deemed invalid, void or for any reason unenforceable, such clause will be deemed severable and will not affect the validity and enforceability of the remaining clauses of the T&C's.

The T&C's (as amended from time to time in accordance with its terms) sets out the entire understanding and agreement between The user/customer and GameStore with respect to the use of the site.

Any failure by GameStore to enforce any terms set out in the T&C's or other policies with the user/customer is not a waiver of GameStore’s rights to enforce those terms.

 

Legal:

Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of Kuwait.
